The controller is the company MARBELLA CLUB HOTEL, S.A. ("MARBELLA CLUB HOTEL"), a Spanish company with registered offices at Avenida Bulevar Príncipe Alfonso de Hohenlohe, s/n, 29602 Marbella, Malaga, and holder of Tax Identification Number A 29054251.

You can contact our Data Protection Officer (a) by sending a letter to the address indicated in the above section of this document, or (b) by sending an e-mail to the following address: rgpd@marbellaclub.com.

On the basis of the type of personal data you consent to share with us by checking the relevant box, we will use your personal data for one or more of the following purposes, as appropriate, depending on what you reasonably expect to obtain from us in that respect or from the service and/or product you have ordered:

a) Handling the registration, reservation, cancellation, and payment of your room and other services you may request (e.g. catering).

b) Managing and providing the services related to your reservation during your stay, such as cleaning, hospitality, preferences, special requests, etc., as well as other additional services not included in the reservation that you may wish to enjoy during your stay.

c) Handling the reservation, requests and cancellation of any other services offered by MARBELLA CLUB HOTEL that, either through our website or in person, you may engage for your enjoyment during your stay or as an external guest, such as reservations in restaurants, at the "WELLNESS SPA" or any other service that we may offer you in the future. 

d) Sending you, whether by traditional means, e-mail and/or other digital means, our promotions, service offers, and news from our hotel or the MARBELLA CLUB HOTEL network and other news that we feel may be of interest to you. 

e) Sending you by traditional means, email and/or other digital means, our newsletter or new "BLOG" posts, as long as you have subscribed to these services. 

f) Handling your application in the corresponding selection process, in the event that you have sent us your CV through the "Careers" section.

g) Using your image for promotional purposes on our social media accounts or other platforms that we may choose, as long as you have expressly consented to such use. 

h) Handling any type of query, complaint, question or need for information that may be required, through our contact form, our corporate email addresses, or our social networks.

i) Handling incidents of any kind that are reported during your stay and require attention. 

j) Ensuring your security within the common areas, both exterior and interior, of the hotel, through video surveillance systems. 

Carrying out statistical analyses and non-invasive market studies that allow us to improve our services and technology.

We will only use your personal data for as long as needed to complete the purposes described in point 3 above. After this, and provided that you do not exercise your right of erasure beforehand, we will keep your personal data, using the mandatory security measures and blocking it with pseudonymization, for a period of thirty (30) days in the case of video surveillance files, two (2) years in the case of management of cleaning services, four (4) years for engagement of additional services, six (6) years for payment and invoicing purposes and five (5) years in all other cases, after which we will proceed to remove them from our information processing system.

Yes, we would like to inform you that, in order to carry out the processing for the purpose(s) indicated above, we may rely on automated decisions, including profiling, such as when we carry out statistical analysis or market research to improve our services and technology.

However, for the purpose of ensuring that your personal data is processed with the appropriate safeguards, in such cases, we will only use specific essential data for creating the profile and, in no case, all the data with which, through your consent or any other legitimate basis, we were provided.

Likewise, we inform you that such automated processing will in no case be detrimental to you, nor will it involve the disclosure, exposure, alteration or manipulation of your personal data, and that its main outcome will be the sending of personalized e-mails according to the circumstances and needs for which you have given us your consent or there is a legitimate interest according to point 3 above.

The MARBELLA CLUB HOTEL has adopted the necessary technical and organisational measures to guarantee the security of the personal data processed and to avoid its alteration, loss and unauthorised processing or access, taking into account the state of technology, the nature of the data stored and the risks to which it is exposed, whether such risks are the result of human action or the physical or natural environment. Specifically, measures have been adopted to achieve basic security objectives, such as confidentiality (understood as limiting access to information by unauthorized persons), integrity (understood as maintaining reliable, quality information) and availability (understood as ensuring access to the information system at the request of an authorized user).

In the event that we use your data to manage the provision of those services directly or indirectly related to your reservation or any other additional services that we may provide you and that you have requested through our website or in person, we will rely on the execution of the contract that we have with you as valid authorisation.

Likewise, for the processing of data in order to ensure your security (video surveillance), a legitimate interest will be deemed valid authorisation. 

In the other cases specified in point 3 above, only as a result of the express consent that you give us by accepting this privacy policy through the corresponding button or box as appropriate.

Insofar as you wish to contact us or engage our services, so that we may carry out the purposes described above, it is necessary for us to process your personal data. Consequently, your refusal to provide it will make it impossible for us to contact you or manage the booking and other similar services during your stay, as well as any other additional services you may request.

We will not pass on your personal data to anyone, unless we are obliged to do so by law or unless you have given your express prior consent.

Notwithstanding the above, in order to provide you with the services referred to above or to send you the communications you request from us, we may need to share your personal data with some of our external partners, such as suppliers of services related to your stay and any services engaged through it, hospitality and room services, activities arranged through the MARBELLA CLUB HOTEL with other suppliers during your stay, providers of logistic and/or computer services such as web site hosting, data analysis, opinion polls, provision of infrastructure, and other similar services.

We will not transfer your personal data to third parties located in countries outside the European Union, except if, in order to comply with the purposes set out in section 3, we need to pass them on to the offices of the MARBELLA CLUB HOTEL network or to other suppliers located in third countries for which there may not be a Commission decision on the adequacy of the level of protection afforded by their personal data protection legislation, but we will always ensure that, in such cases, appropriate safeguards are implemented.
